Definitions

The information herein relates specifically to "CalypsoNet" and "My CalypsoNet".

CalypsoNet ("Site") provides registered users with access to travel wholesaler systems ("The Wholesalers").

My CalypsoNet ("Portal") is a functionality of the Site which is owned and operated by Tourism Technology.

Tourism Technology ("TT") means Tourism Technology Pty Ltd ABN 97 050 105 505


Background
The Site provides registered users with access to The Wholesalers and the Portal has been set up to allow a more manageable access point to The Wholesalers.  TT does not have any control over The Wholesalers as it only provides the access facility through the Site.

Disclaimer
The Site and Portal are provided on an "as is" basis without warranties of any kind.  TT expressly disclaims any representations and warranties, including without limitation, the implied warranties of merchantability and fitness for a particular purpose.  TT shall have absolutely no liability in connection with or access to The Wholesalers including without limitation, any liability for damage to your computer hardware, data, information, software, materials and business resulting from the Site and Portal or the lack of information.

TT shall have no liability for:
1. Any loss or injury caused, in whole or in part, by its actions, omissions or negligence, or for contingencies beyond its control, in supplying, procuring, compiling or delivering the Site and Portal to provide access to The Wholesalers;
2. Any errors, omissions or inaccuracies in the Site and Portal regardless of how caused, or delays or interruptions in delivery of access to the Site and Portal;
3. Any decision made or action taken or not taken in reliance upon the Site and Portal; or
4. Any loss or injury caused from withdrawing access or use of the Site and Portal.

Limitation of Liability
To the fullest extent permitted by applicable laws, TT hereby excludes liability for any claims, loss, demands or damages of any kind whatsoever with respect to your use of the Site and Portal including, without limitation, direct, indirect, incidental or consequential loss or damages, whether arising from loss of profits, loss of revenue, loss of data, loss of use or otherwise and whether or not the possibility of such loss has been notified to TT.  The foregoing will apply whether such claims, loss or damages arise in tort, contract, negligence, under statute or otherwise.

Warranty
You warrant that you have the authority to access and use The Wholesalers and hold all requisite access codes for The Wholesalers.  TT is not in any way responsible for ensuring your entitlement or authority to use The Wholesalers.  It is your responsibility to immediately notify TT of any unauthorised use of any access codes or accounts or any other known or suspected breach of security or privacy laws or regulations.
You hereby indemnify TT from and against any claim for damages arising from your use or access of the Site, Portal and/or The Wholesalers.

Privacy Statement
TT is committed to maintaining the trust and confidence of our customers and visitors to the Site. In particular, we will not sell or rent individuals' personal data to other companies.
We collect both personal (email, name, and agency details) and non-personal (visitor statistics through use of cookies) to aid our future product enhancements and targeted marketing communications.
If you agree to receive periodic email marketing correspondence from us you will be given the option to unsubscribe, with this option to be located at the bottom of every email communication.

Security of Personal Information
We have implemented industry-standard security mechanisms and procedures to protect data from loss, misuse and unauthorized access, disclosure, alteration and destruction.  Any information we hold for you is stored on secure servers that are protected in controlled facilities.  We also provide email address verification by sending you an email with a temporary password login before opening your account.

No part or the entirety of this website can be reproduced in any format without the explicit written permission from TT.
